Terms and Conditions for Events : Byoma Limited

These Ticket Terms and Conditions set out the terms and conditions that apply between:

(i)          you as a purchaser of tickets for the Event (defined below) or, if you are not the purchaser of tickets for the Event, you as a holder of a ticket for the Event (referred to as "you" or "your") and

(ii)         (ii) us, BYOMA Limited, a company registered in England and Wales under company number 13823187 and having its registered office at 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX ("BYOMA", "we" or "us").

 

The “Event” means the BYOMA event for which you are registered as an attendee on Eventbrite Inc.

1.          Booking, Purchase and Delivery of Tickets

1.1        Tickets for the Event are subject to availability.

 

1.2        Tickets

1.2.1    The booking and payment process for the Event is facilitated by Eventbrite Inc. (the “Provider”). Your personal information will be processed on our behalf by the Provider and any subsequent data processor supplying booking and payment services in accordance with our instructions and in compliance with any applicable data protection legislation.

1.2.2    You may only purchase a maximum of two (2) tickets per time slot of the Event.

1.2.3    All tickets will be issued digitally, details of which will be confirmed by the Provider to ticket holders prior to the Event.

1.2.4    Where you purchase and/or are allocated any ticket(s) which are for use by other people, you must transfer the ticket to each person who will be attending the Event as soon as possible following your receipt of the ticket(s).Each person attending the Event must have their own mobile ticket on their own device. You will not be allowed to enter the Event without a valid mobile ticket.

1.2.5    Attendees under the age of16 years are required to have a parent/legal guardian/adult aged 18+ in attendance. We may ask you to provide proof of age if we believe that you look under 16 years of age. BYOMA reserves the right to refuse admission if you are unable to provide satisfactory proof of age on request and you will be entitled to request a refund from the Provider.

 

1.3        General

1.3.1    When you are the purchaser of tickets, your purchase of tickets will be completed when we/ the Provider deliver the tickets to you.

1.3.2    This may be by email or download, or on the Provider’s website or app.

1.3.3    BYOMA reserves the right to choose to accept or reject your order whether for all or any number of the tickets requested. In the case of an order being rejected in whole or in part, you will be notified as soon as reasonably practicable. Such notification may not be received until we have had an opportunity to complete all pre-despatch ticket checks. Our failure to notify you of the rejection of your order in whole or in part does not mean that your order has been accepted.

1.3.4    BYOMA will accept no responsibility for, or offer any refunds for, loss arising as a result of any incorrect information provided by you at the time of purchase, unless this is due to our error.

 

2.          Refunds

2.1        Cancellation of your order

2.1.1    If, after you have placed your order, you wish to withdraw or cancel your order then you may do so by informing us/ the Provider no later than 24 hours before the Event. You will not be entitled to cancel your order or be entitled to a refund less than 24 hours before the event.

2.1.2    If you withdraw or cancel your order within these timeframes, we shall reimburse the payment made by you within 30 days of receiving your notification that you wish to cancel your order. All refunds will be processed by the Provider.

 

2.2        Cancellation of the Event

2.2.1    If the Event is cancelled, we will use our reasonable endeavours to notify you as soon as we reasonably can.

2.2.2    If the Event is cancelled, you shall be entitled to a refund of the cost of the ticket(s). Refunds will be available through the Provider in accordance with the refund process communicated by BYOMA following the date of cancellation. To request a refund, please contact the Provider.

 

2.3        Postponement prior to the Event

2.3.1    If the Event is postponed, BYOMA will honour tickets for the re-scheduled date(s) of the Event.

 

3.          Payment

3.1        Prices quoted are in Pounds Sterling and are inclusive of applicable VAT.

3.2        Payment in full must be made prior to despatch of the ticket(s) in accordance with clause 3.3 below.

3.3        If your payment is rejected, then we or the Provider will notify you and your order will not be fulfilled, and we have the discretion not to fulfil or process any other order received from you.

3.4        BYOMA shall not be responsible for any exchange rates, fees, or charges levied by your bank or payment card provider.

 

4.          Liability

4.1        If we are in breach of these Ticket Terms and Conditions, we will not be responsible for any losses that you suffer as a result, unless the losses are a foreseeable consequence of the breach. Loss or damage is foreseeable if either it is obvious that it will happen or where it could be contemplated by you and us at the time you purchased your tickets.

4.2        BYOMA’s total liability to you under these Ticket Terms and Conditions will not exceed the purchase price of the ticket(s) purchased by you.

4.3        BYOMA will not be responsible for paying any compensation to you for any loss or damage to property incurred at the Event unless the loss or damage was suffered as a result of our negligence.

4.4        Nothing in these Ticket Terms and Conditions shall limit any rights you may have which are not capable of being lawfully excluded or limited, nor shall these Ticket Terms and Conditions exclude or restrict our liability to you for any death or personal injury resulting from our negligence.

4.5        Please note that all events are provided for domestic and private use only. You therefore agree not to use the Event for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

 

5.          Re Admission

Re-Admission will be not permitted at the Event.

 

6.          Venue

6.1        You acknowledge that you are subject to, and you agree to comply with the safety protocols applicable at the venue for the Event. It is your responsibility to check the terms and conditions of attendance at the venue for the Event.

6.2        You must not bring any of the following to the Event:

6.2.1    any item which may be interpreted as a potential weapon including sharp or pointed objects (e.g. knives);

6.2.2    laser pens, fireworks, flares, smoke bombs;

6.2.3    alcoholic drinks;

6.2.4    any illegal substance;

6.2.5    bottles, cans or glass containers (unless the venue allows this); or

6.2.6    animals (except assistance dogs that meet the Equality and Human Rights Commission description: highly trained, will not wander freely around the premises, will be able to sit or lie quietly on the floor next to its owner, trained to go to the toilet on command and so unlikely to foul in a public place, recognisable by the harness or identifying coat they wear).

6.3        You must at all times follow the instructions of the Event or venue officials and/ or security personnel.

6.4        The venue may operate CCTV cameras and other surveillance at its discretion. BYOMA is not responsible for the venue’s surveillance activities.

6.5        If you need special access arrangements, please contact the venue. The venue (not BYOMA) is responsible for arranging any such access.

 

7.          Use of Tickets

7.1        You must not post pictures of your ticket on social networking sites. People may use the details and offer them for sale online to defraud/attempt to defraud third parties into buying them. This may result in ticket holders encountering difficulties when attending the Event.

7.2        Where BYOMA or the Provider have reasonable grounds to suspect that a ticket has been copied, re-sold by an unauthorised person or company, or has been altered in any way without the consent of BYOMA, then we, the venue or security contractors may seize and retain that ticket and may refuse entry to the Event where this is deemed appropriate.

8.          Attendance at The Event

8.1        We ask that you arrive at the Venue no earlier than 15 minutes before the Event start time. There may be queues on arrival.

8.2        If you arrive at the Venue more than 15 minutes after the start time of the Event, at our discretion, BYOMA may refuse entry and you will not be entitled to a refund of your ticket. Depending on numbers, you may be able to join the on-site walk-in queue but entry is not guaranteed.

8.3        Mobile phones and cameras are permitted at the Event. You may use them for recording and transmitting (by digital or other means) any audio, visual or audio-visual material during a BYOMA Event unless for any reason you are asked not to do so at the Event.

8.4        If you need any special assistance during the Event, such as support for any sight or hearing impairment (including hearing loops), sensory needs or other conditions which require additional support, please contact BYOMA at [events@byoma.com] at the time of booking your tickets so that the appropriate arrangements can be made to assist you. If you do not tell us that you need any special assistance, we will try to accommodate you on the day but BYOMA cannot guarantee that the required assistance will be available at the Event.

8.5        Please be aware that the Event may include loud noises, music and sounds, and bright or flashing lights. This may affect attendees with epilepsy, sensory sensitivities or other conditions.  If you think you may be affected by this, please ensure you take any precautions you need if attending the Event, or contact us at [events@byoma.com] at the time of booking your tickets for guidance.

 

9.          Health and Safety

9.1        You acknowledge that it is your responsibility to be aware of any food allergies or dietary requirements, and any food allergies and dietary requirements of any individuals you buy a ticket for.

9.2        You may only consume food and drink purchased at the Event or provided by us free of charge at the Event.

9.3        For events involving alcohol you agree that you and any participants you have booked the Event for are legally old enough to drink alcohol. You agree that you and they will consume any alcohol responsibly.

9.4        There may be age restrictions at events.  Identification verification will be required at the venue of the Event if any age restrictions are applicable. This includes events that involve alcohol purchased or provided by us free of charge at the Event and you may only purchase or consume alcohol if you are of an age where you are permitted to do so by the venue for the Event.

9.5        We reserve the right to impose COVID-19 or any other health and safety restrictions, you must comply with these while attending the Event. Anyone who refuses to comply with such restrictions may have their tickets cancelled, be refused entry, or removed from the Event, and in such circumstances, will not be entitled to a refund.

 

10.        Conduct

10.1     It will be considered by us to be a breach of these Terms and Conditions if you have at the Event any objects or clothing bearing commercial identification which BYOMA has reason to believe is intended for “ambush marketing” or other unauthorised promotional purposes. We reserve the right to take appropriate action against anyone that we consider to be involved in “ambush marketing”.

10.2     Where you, through your negligence or intentional or reckless act, cause damage or loss to BYOMA or to any property at the Event (including, without limitation, products, equipment or facilities), you will be responsible for compensating the person who has suffered the loss or damage.

10.3     You may be removed from, or refused access to, the Event if, in the reasonable opinion of BYOMA your behaviour is, or could be considered to be dangerous, offensive, a nuisance or annoying to other attendees, the Event officials and/ or security personnel. For example, if you appear under the influence of alcohol and/ or drugs and/ or are acting aggressively, or if you fail to obey any conditions of use, posted signs, or instructions of the Event officials and/ or security personnel. If you are refused admission to the Event under these circumstances, you will be entitled to a full refund of your ticket. If you are removed from the Event under these circumstances after gaining entry, you will not be entitled to a refund.

10.4     We will not tolerate any behaviour or conduct which, in which our reasonable opinion, poses a danger or causes or is likely to cause nuisance, annoyance, offence, or distress to any attendee or presenter at a BYOMA event. We reserve the right to refuse to let you attend other BYOMA events and / or take appropriate legal action if a legitimate complaint is made about your conduct during a BYOMA event.

 

11.        Goody bag/ Gifting

11.1     The cost of your ticket is redeemable in all Boots stores against BYOMA products, but each ticket may only be used once. Tickets are not redeemable against BYOMA gift sets. Redemption requires production of a valid ticket. This offer is valid until 11:59pm on 14th December 2025. No cash equivalent is available.

11.2     If the Event includes a gift or goody bag:

11.2.1 details of any goody bags/ gifts will be available on the event page when booking your ticket;

11.2.2 you will be entitled to one gift or goody bag per ticket only;

11.2.3 you must be present at the Event in order to receive a gift or goody bag;

11.2.4 contents of the gift or goody bags are subject to availability;

11.2.5 gifts and goody bags are non-transferable, non-refundable and there are no cash alternatives (we will not exchange them for cash);

11.2.6 the gifts and goody bags will only be given at the event you have purchased a ticket for;

11.2.7 gifts and goody bags will not be sent out or saved for anyone who is unable to attend the Event;

11.2.8 contents of the gift or goody bag may vary and if for any reason we are unable to provide the gift or goody bag as described in these Terms and Conditions or if for any reason fulfilment of the gift or goody bag is impacted by anything outside of our control, we reserve the right to substitute the items, in our sole discretion, with items of equal or higher value.

12.        Intellectual Property

12.1     We are the owner or the licensee of the intellectual property rights in our websites, brands, social media and at the Event, as well as any Event content and materials. These works are protected by trademarks and copyright law, and all such rights are reserved. You must not use any part of the Event content or materials for commercial purposes without obtaining a licence to do so from us or our licensors.

 

13.        Personal Data and Images

13.1     Any personal data provided by you will be used by us in accordance with our Privacy Policy (as amended from time to time), which is available at [INSERT PRIVACY POLICY]. 13.2     In agreeing to these Ticket Terms and Conditions and attending the Event, you consent to being filmed, photographed, streamed and recorded for television, radio, webcast, social media and other public broadcast in any medium and/or for any video or DVD as part of the audience and/or, for security purposes, by any CCTV cameras and recordings at the Event. You also agree that we can utilise your image or likeness or the image or likeness of a member of your party in, or incidental to, any photograph, video or live, streamed or recorded television or in any other type of transmission or reproduction, in whole or in part, and that you shall not be entitled to any compensation or credit. This may include use of footage and images for marketing purposes and includes footage and images broadcast or published by BYOMA and by any third party rights holders. If you do not wish to appear in such images, please contact us at [events@byoma.com] before the Event.

 

14.        General Ticketing Conditions

14.1     You may not transfer any of your rights under these Ticket Terms and Conditions.

14.2     If any provision of these Ticket Terms and Conditions is found to be invalid by any Court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Ticket Terms and Conditions, which shall remain in full force and effect.

14.3     If you are resident within the European Union, then the contract between us shall be governed by the law of the country within the European Union in which you are resident and any dispute arising under this contract shall be referred to the relevant courts having authority in that country. If you are not resident in the European Union, then the contract between us shall be governed by the laws of England and Wales and any disputes relating to that contract shall be decided in the English Courts.
